The decision came to light on the heels of a case of a 69-year-old man, identified only as “Pietro L”, who was caught in May 2015, taking out his “manhood” and then practicing “autoeroticism” better known as masturbation in front of students at the University of Catania, a city on Sicily’s east coast.
According to the local edition of La Repubblica, the local Prefect of Catania and the Court of Appeal had agreed that the man should be sentenced to three months in prison and fined €3,420.
But the country’s highest court overturned the decision, saying, “The act is not included in the law as a crime.”
In doing so, the court has eliminated the criminal aspects of sentencing for obscene acts in public places, while the accused must now await a fine between €5,000 and €30,000, with the exact figure to be determined by the local court.
It should be noted, public masturbation remains a ‘serious’ criminal offense in many other parts of the world, where it can lead to a jail sentence.
